Facebook Scores Rare Win In Privacy Case

For years, Facebook has dealt with an onslaught of litigation related to its suspect privacy practices, especially surrounding the 2018 Cambridge Analytica data breach. Many of these cases are beginning to reach their conclusions, with Facebook often being held accountable with hundreds of millions of dollars in fines or settlements. However, the social media giant was able to score an increasingly rare win in Canada this week, with a judge ruling that a privacy watchdog did not establish Facebook failed to get user consent before gathering their data.

Following the events of that now-infamous Facebook privacy scandal, Canadian regulators launched an investigation and concluded that the company had violated the country’s privacy laws while not offering adequate safeguards to protect user information. Of course, Facebook disputed that claim, and asked the court to toss the watchdog’s findings. While the court did not dismiss the report altogether, the presiding judge also said that the watchdog had not done enough to prove their point.

Justice Michael Manson said the court would have to “speculate and draw unsupported inferences from pictures of Facebook’s various policies and resources as to what a user would or would not read; what they may find discouraging; and what they would or would not understand.”

This is a relatively small win for Facebook in the grand scheme of things, but it’s still notable with the many legal losses the company has suffered around the world for its privacy violations.
